1) Who operates the Service
ChallengeBuilder is operated by Finau Bateman Seletrading as ChallengeBuilder (“ChallengeBuilder”, “we”, “us”, “our”).

2) Beta availability
During public beta, the Service is not intended for residents of the United Kingdom or the European Economic Area. If you are located in the UK/EEA, do not use the Service during beta. We may restrict access by region at our discretion.
3) Definitions
- “You” means the user of the Service (participant, organiser, or admin).
- “Organiser”means a person or organisation that creates or manages a challenge (for example a school, club, workplace).
- “Content”includes challenge names, descriptions, rules, entries/results, images, comments, and any other material submitted to the Service.
4) Platform-only role
ChallengeBuilder is a software platform that helps organisers and participants record entries and view challenge information (including leaderboards and summaries). We do
not organise, supervise, verify, or control any real-world activity, event, venue, or challenge rules. Challenges are run by organisers and participated in by users at their own risk.
5) Eligibility and minors
Eligibility and minors You must be able to form a legally binding contract in your jurisdiction to use the Service, unless you are using it through an Organiser that has authority and consent to allow your participation. If participants are minors, the Organiser is responsible for obtaining any required parent/guardian permissions and consents, and for ensuring the challenge is appropriate and safe.
6) Accounts and security
- You are responsible for maintaining the confidentiality of your login credentials.
- You must provide accurate information and keep it up to date.
- You must not impersonate others, share accounts inappropriately, or access accounts you are not authorised to use.
- You must notify us if you suspect unauthorised access to your account.
7) Acceptable use
You agree not to:
- Submit deliberately false, misleading, or fraudulent entries
- Harass, bully, abuse, or threaten others
- Upload malware or attempt to disrupt the Service
- Attempt unauthorised access, scraping, reverse engineering, or interference with security
- Infringe intellectual property or privacy rights
- Use the Service in a way that violates any applicable laws or regulations
We may suspend or terminate access if we reasonably believe you have breached these Terms or if required to protect the Service or users.
8) Challenges, results, and fairness
- The Service may display leaderboards and summaries based on entries submitted by users.
- Unless a challenge explicitly uses verified integrations or organiser verification, entries are self-reported and may be inaccurate.
- Organisers are responsible for setting rules (what counts, verification requirements, prizes, and dispute handling) and for resolving disputes within their challenge.
9) Health and safety disclaimer
ChallengeBuilder supports tracking and group motivation. It does not provide medical, health, or training advice. You are responsible for choosing activities appropriate to your health and circumstances. Stop if you feel unwell and seek professional advice where needed. In an emergency, contact local emergency services.
10) Content you submit
- You retain ownership of the Content you submit.
- By submitting Content, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, and process your Content solely to operate, maintain, and improve the Service and to display it within relevant challenges (for example leaderboards and team pages).
- You represent that you have the rights needed to submit the Content and that it does not violate any laws or third-party rights.
11) Intellectual property
We own (or license) all rights in the Service, including software, design, branding, and documentation, except for user Content. You must not copy, modify, distribute, sell, lease, or reverse engineer any part of the Service unless we give written permission, except where the law does not allow this restriction.
12) Paid plans, billing, and refunds
If you purchase a subscription or paid features:
- Prices, billing frequency, and inclusions will be shown at checkout or in an order form.
- Payments are processed by third-party payment providers (for example Stripe). You agree to their terms as applicable.
- Taxes may apply depending on your location and the nature of the purchase.
- Subscriptions may renew automatically unless cancelled before the renewal date (where applicable).
Refunds: Except where required by law, payments are non-refundable unless your plan terms explicitly state otherwise.
13) Third-party services
The Service may integrate with or link to third-party services (for example Stripe, Google, Apple, fitness devices, analytics tools). We are not responsible for third-party services and their terms, availability, or privacy practices.
14) Availability, beta status, and changes
The Service may be offered as a public beta. Features may change, be added, removed, or discontinued. We aim to keep the Service available, but we do not guarantee uninterrupted access. We may perform maintenance or suspend the Service where reasonably necessary.
15) Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available”. We do not warrant that:
- the Service will be uninterrupted, secure, or error-free
- data, leaderboards, or results will be accurate (particularly where user-submitted)
16) Limitation of liability
To the maximum extent permitted by law:
- We are not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill.
- We are not responsible for real-world activities, injuries, incidents, or disputes arising from participation in challenges, which are controlled by users and organisers.
Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the 12 months before the event giving rise to the claim, or NZD 100 if you paid nothing. Nothing in these Terms limits liability that cannot be excluded under applicable law.
17) Indemnity
You agree to indemnify and hold us harmless from claims arising out of:
- your Content
- your misuse of the Service
- your breach of these Terms
- your violation of any law or third-party rights
18) Governing law
These Terms are governed by the laws of New Zealand. Courts in New Zealand will have non-exclusive jurisdiction, except where consumer protection laws require otherwise.
19) Changes to these Terms
We may update these Terms from time to time. We will update the “Last updated” date and, where appropriate, provide notice through the Service. Continued use after changes means you accept the updated Terms.
